Greenhouse vs Provocateur: It's On
We all know that Iron Mike Satsky and Mark Birnbaum were not the best of the friends, but a new battle is brewing between the Champ and Brian Gefter at Provocateur and Jon B., Barry Mullineaux and the Greenhouse crew. It seems that the Greenhouse team has bought the URL's for Provocateur and pointed them to the Greenhouse website. BURN! When asked for comment, a rep for Provacateur said, "This is like Payless stealing the Christian Louboutin domain name." DOUBLE BURN! Of course, Barry used to work with Satsky and Gefter at Stereo before teaming up with Jon B. at Greenhouse, and they will be going after the same clientele. But Provocateur is smack dab in the middle of the MPD, and Greenhouse is by the tunnel. Advantage: Provocateur! Maybe they should get Seven On Their Side to get their URL back. [NYP]

Provocateur owns ProvocateurNY.com and ProvocateurNewYork.com.
Very shady and they will most likely have to give it up, unless Greenhouse can prove a legit reason as to why it's owned.

Geftner & Satsky owe the entire city money, they have no alliances, liquor companies don't want to work with them, promoters don't want to work with them. Actually, stealing a domain name like this is illegal. It is called Cybersquatting. If the name of something is protected by a trademark or copyright you cannot steal the domain name. When the internet was first getting big people would steal names and then sell them back to the copyright holder for big money. People sued and it was outlawed. Assuming Satsky and Gefter have protected the name, they may have a legal action against the Greenhouse crew.
Simply untrue. You can be forced to provide a legitimate reason for owning a domain which bears either someones name, or place of business. You cant buy LebronJames.com and sell t-shirts on it. You can be sued for using someones name and likeness for profit and you will have to give up the domain. Read up on it. ciao

2. you DO have to prove that you have a legitimate reason to hold a domain name if someone else holds the trademark to the same name and has a legitimate business interest in the name you're using. see here:

i would be more concerned with Agent Provocateur (a legitimate business) then with this half-ass, mickey mouse operation being fronted by two d-list promoters who are despised by their industry.
My bet is that gefter and satsky trademarked the name after the domain was purchased. I dont think they have a case then. either way, what idiots for not buying all the domains as soon as they came up with the name.

can't trademark a name like provocateur for anything other than it's specific purpose- restaurant and nightclub (same trademark class), because it is too common a word. i wouldn't be surprised at all if agent provocateur came after them. satsky owns the trademark, you can find it on the uspto website.
there is also a trademark for provocateur for wine. they could also come after them and suggest there might be confusion. all depends on their willingness. my guess if the trademark is safe, but that doesn't mean at all that someone else can't have the url www.provocateurnyc. that could be used for anything.
if it was something like tenjune, which is a completely made up word and trademark, that would be easy to fight. or a well established brand like ford or coke. but not provocateur.
I just Looked online, Provocateur is Trademarked by Satsky last year October 08.
"Provocateur" Serial Number 77584259 was filed with the USPTO for Class #41, Restaurant / Lounge / Night Clubs..... Looks they are on track to receiving a registration number......
But the truth and reality is the Domain Name "provocateurnyc.com was purchased by Greenhouse at GoDaddy.com and cost them $10.69. Many Valid points were made above, but what would anyone do in this situation, spend thousands of dollars on legal fees fighting a pointless battle.....unfair and unjust, but who really cares.......
if you mix up the last few letters of add a word "lounge" "nightclub" "New York" NYC so on..........

I've worked this terrible, disgusting business as a bartender/bottle server for many years. I'm owed money from nearly everyone- Pink Elelphant, Citrine, Bijoux, PM..etc.
I've only worked for Satsky for a short period of time, but he made sure his girls, busboys and promoters were paid in full after every night of work- even if it came out of his own pocket (yes-very true).
He may be a difficult personality, but he runs an honest business.

lets be honest... who actually goes to the websites of any of these clubs... the only thing people ever see is the party invites in their inbox with the club logo and the details of the event... this is NOT a big deal... get over it gefter... and grow up barry... enough is enough...
i'm sure they wouldn't pull a move like that without checking out the legal issues first. They're smart business people.
all the out of towners and eurotrash looks on the website and they drop a good amount of money when they're on vacation. you'd be surprised.
Despite whats being said, from what i hear they are putting 7 million in to this space that was stripped to scratch, they are not doing a concept thats out there or has been done ever, these guys are assholes and total pricks and wont be letting anyone in because there pockets are endless. I hate to say it, but its a recipe for Success. fut i hope they fail!

however there is always new young kids who need jobs.
and people do get burned out fast and move on to other things.
